1. Who we are

This website is operated by Xero Industries, Inc. (“XeroPlastic,” “we,” “us,” or “our”), a manufacturer and brand of biodegradable, compostable, and bio-based materials and products based in Bainbridge Island, Washington, also offering consulting services. These Terms of Service (“Terms”) govern your use of xeroplastic.com and xeroindustries.com (each, the “Site”).

2. Acceptance of these terms

By visiting or using the Site, you agree to these Terms. If you don't agree, please don't use the Site.

3. What this Site is, and isn't

The Site provides general information about XeroPlastic's products, materials, industries, technologies, and consulting services. Nothing on this Site constitutes a binding offer, a professional engagement, or specific compliance, legal, or regulatory advice for your business.

Any actual consulting engagement (a Conversion Screen, Conversion Audit, EPR/PPWR Readiness Sprint, Material Selection & Validation project, or Retained Advisory relationship) is governed by a separate written agreement between you and Xero Industries, Inc., which will set out scope, fees, timelines, and deliverables. These Terms apply only to your use of the Site itself.

4. No professional advice from Site content

Information on the Site (including material and industry descriptions) is general in nature and provided for informational purposes only. It is not a substitute for engagement-specific analysis, and it does not guarantee that any particular material, supplier, or approach will meet your regulatory, performance, or cost requirements. Regulations such as state EPR programs and the EU Packaging and Packaging Waste Regulation (PPWR) change over time and vary by jurisdiction and product; you should confirm current requirements independently or through a signed engagement with us.

5. Intellectual property

The Site's text, graphics, logos, and layout are owned by Xero Industries, Inc. or its licensors and are protected by copyright and other intellectual property laws. You may view and share Site content for personal or internal business reference, but you may not reproduce, republish, or create derivative works from it for commercial purposes without our written permission.

6. Acceptable use

You agree not to use the Site to:

• Attempt to gain unauthorized access to the Site or its underlying systems
• Interfere with the Site's normal operation, including through automated scraping or overload
• Submit false, misleading, or fraudulent information through our contact form
• Use the Site for any unlawful purpose

The Site may link to third-party websites (for example, supplier or certification bodies). We don't control and aren't responsible for the content, accuracy, or practices of third-party sites.

To the fullest extent permitted by law, Xero Industries, Inc. and its founders, employees, and agents won't be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of, or inability to use, the Site, even if advised of the possibility of such damages. Our total liability for any claim arising from the Site itself (as distinct from a separately signed engagement agreement, which will have its own terms) is limited to one hundred dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless Xero Industries, Inc. from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or violation of these Terms.

11. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Washington, and you consent to that jurisdiction and venue.

12. Changes to these Terms

We may update these Terms from time to time. The “Effective date” above reflects the most recent revision. Continued use of the Site after changes take effect means you accept the revised Terms.
